The Body Institute LLC, doing business as Body Axis™ ("Body Axis™," "we," "us," or "our"), operates the Body Axis™ mobile application, website, and related products and services collectively referred to as the "Services."
This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you access or use the Services.
By accessing or using Body Axis™, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.
1. Information We Collect
The information we collect depends on how you interact with Body Axis™ and which features you choose to use.
A. Information You Provide to Us
Account Information
When you create or manage an account, we may collect information such as: Name, Email address, Telephone number (if provided), Username or account identifier, Password or authentication information, Profile photograph (if provided), Communication preferences.
Movement and Wellness Information
To create and personalize your Body Axis™ experience, we may collect information you voluntarily provide about your movement, wellness, and fitness goals, including: areas of the body you want to address; whether an area feels stiff, tight, weak, unstable, achy, or uncomfortable; mobility and range-of-motion concerns; movement limitations; exercise experience; activity level; fitness or movement goals; exercise preferences; equipment availability; preferred session length; plan selections and completed plans; and responses to movement assessments or questionnaires.
This information is intended to personalize educational movement and exercise content. Body Axis™ is not a medical provider, and information submitted through the Services should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Progress and Activity Information
We may collect information about your activity within the Services, including: exercises and movement plans completed; sets, repetitions, time, or other exercise entries; session history; progress markers; streaks; areas of the body addressed; saved or favorited exercises; assessment results; and feedback about exercises or plans.
Nutrition Information
If you choose to use nutrition-related features, we may collect information such as: nutrition goals; dietary preferences; food preferences; allergies or ingredient exclusions; height, weight, age, and activity level; calorie or macronutrient targets; meal-plan selections; saved recipes; and information you enter into nutrition questionnaires.
Nutrition features are provided for general educational and wellness purposes and are not intended to diagnose, treat, or manage a medical condition.
Communications and Support
When you contact us, submit feedback, respond to a survey, or request support, we may collect: the content of your message; your contact information; information about your account or technical issue; screenshots or files you choose to provide; and records of our communications with you.
Purchase and Subscription Information
Body Axis™ may offer paid subscriptions or other purchases through Apple's App Store, Google Play, or another authorized payment platform.
The applicable payment platform processes your payment details. Body Axis™ generally does not receive or store your complete credit or debit card number.
We may receive information related to your purchase, including: subscription status; subscription type; purchase date; renewal or expiration date; transaction or receipt identifier; trial eligibility; refund or cancellation status; and country or region associated with the transaction.
We may use a subscription-management provider, such as RevenueCat, to verify purchases and manage subscription access.
B. Information Collected Automatically
When you use the Services, we and our service providers may automatically collect technical and usage information, including:
Device and Technical Information: device type; operating system and version; app version; browser type; language and regional settings; Internet Protocol address; mobile network information; device or app identifiers; time zone; general location inferred from an IP address; push-notification token; and log and diagnostic information.
Usage Information: dates and times the Services are accessed; features, screens, and content viewed; buttons or links selected; search activity within the Services; session duration; exercise and plan interactions; app performance; crashes, errors, and troubleshooting information; and referring webpage or source, when applicable.
We use this information to operate the Services, understand how features are used, resolve technical problems, protect accounts, and improve the user experience.
C. Camera, Photograph, and Video Information
Certain current or future Body Axis™ features may allow you to use your device camera, upload a photograph or video, or participate in a movement assessment.
When you choose to use one of these features, we may process: photographs or video recordings you submit; body-position and movement information; joint-position or range-of-motion estimates; balance, posture, or movement-assessment results; and technical information needed to process the assessment.
We will request device permission before accessing your camera, photographs, or videos.
We do not use photographs or movement videos for facial recognition or identity verification. We do not use identifiable health, movement, photograph, or video information to train a generalized artificial-intelligence model unless we first provide clear notice and obtain any consent required by law.
Your developer must confirm whether photographs or videos are processed only on your device, temporarily transmitted to a server, stored in your account, or deleted immediately after analysis. This Privacy Policy must be updated to describe the actual process before a camera-based assessment feature is released.
D. Information From Third Parties
We may receive information from third parties that help us operate the Services, including: Apple; Google; subscription and payment platforms; authentication providers; cloud-hosting providers; analytics providers; crash-reporting and diagnostic providers; email and notification providers; and customer-support providers.
The information we receive depends on the third-party service, your settings, and the permissions you provide.
If you sign in using Apple, Google, or another third-party login provider, we may receive information such as your name, email address, account identifier, and authentication confirmation.
2. How We Use Your Information
We may use collected information to: create and manage your account; authenticate users and protect accounts; provide access to Body Axis™; generate or recommend movement plans; personalize exercises, plans, and educational content; record completed sessions and progress; provide movement or wellness assessments; provide nutrition features when available; process and verify subscriptions; restore purchases; communicate about your account or subscription; send service-related notices; send push notifications you have enabled; respond to questions and support requests; diagnose crashes and technical problems; analyze app performance and feature use; develop and improve the Services; prevent fraud, misuse, and unauthorized activity; enforce our Terms of Service; comply with legal obligations; protect the rights, property, and safety of Body Axis™, our users, and others; complete a business transaction, such as a merger or acquisition; perform another purpose disclosed to you when the information is collected; and carry out another purpose with your consent.
3. How We Personalize Your Experience
Body Axis™ may use the information you provide about your movement concerns, goals, preferences, and completed activities to recommend relevant movement plans and exercises.
Recommendations generated through the Services are educational and are based on the information available to the system. They are not a medical diagnosis, physical-therapy evaluation, or individualized treatment plan.
You are responsible for deciding whether an exercise is appropriate for you. Stop any activity that causes pain, dizziness, numbness, shortness of breath, or another concerning symptom, and seek appropriate medical care when needed.
4. How We Share Information
We do not sell your personal information.
We do not share identifiable health, movement, nutrition, photograph, or video information for targeted or cross-context behavioral advertising.
We may disclose information in the following circumstances:
A. Service Providers
We may provide information to vendors and contractors that perform services on our behalf, including: cloud hosting and data storage; database management; account authentication; subscription verification; payment processing; app development and maintenance; analytics; crash reporting; security and fraud prevention; email delivery; push notifications; and customer support.
These providers are permitted to process information only as necessary to provide their contracted services or as otherwise permitted by law.
B. Apple, Google, and Subscription Platforms
Information related to app downloads, subscriptions, purchases, renewals, and refunds may be exchanged with Apple, Google, RevenueCat, or another payment or subscription-management provider. Those providers process information according to their own terms and privacy policies.
C. With Your Direction or Consent
We may disclose information when you request or authorize us to do so. For example, if you choose to connect Body Axis with another health, fitness, nutrition, or device platform, information may be exchanged based on the permissions you approve.
D. Legal and Safety Requirements
We may disclose information when we reasonably believe it is necessary to: comply with a law, regulation, subpoena, court order, or legal process; respond to a lawful government request; investigate suspected fraud, security incidents, or illegal activity; enforce our agreements and policies; and protect the safety, rights, or property of Body Axis™, our users, or another person.
E. Business Transactions
Information may be disclosed or transferred as part of a proposed or completed merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction. Any successor organization will be required to handle personal information in accordance with applicable law and the privacy commitments in effect at the time of the transfer.
F. Aggregated or De-Identified Information
We may use or disclose information that has been aggregated or de-identified so that it cannot reasonably be linked to an individual. We will not attempt to re-identify de-identified information except when necessary to test whether our de-identification processes are effective or as otherwise permitted by law.
5. Sensitive and Consumer Health Information
Information about your body, movement concerns, exercise activity, nutrition preferences, symptoms, assessments, photographs, or videos may be considered sensitive information or consumer health information under certain laws.
We use this information only for purposes reasonably necessary to provide the features you request, operate the Services, protect the Services, comply with the law, or carry out another purpose with your authorization.
Body Axis does not sell consumer health information. Body Axis does not use consumer health information for targeted advertising. We do not provide identifiable movement, health, or nutrition information to data brokers.
Where required by law, we will obtain your consent before collecting, using, or disclosing sensitive or consumer health information for a purpose that is not reasonably necessary to provide the Services you requested.
Body Axis is a consumer wellness and educational service. It is not a healthcare provider, health plan, or healthcare clearinghouse. Information you provide to Body Axis™ may not be protected by the Health Insurance Portability and Accountability Act, commonly known as HIPAA. Other privacy and consumer-protection laws may still apply to this information.
6. Cookies and Similar Technologies
Our website and web-based Services may use cookies, software-development kits, pixels, local storage, or similar technologies. These technologies may be used to: keep you signed in; remember preferences; maintain security; understand website and app activity; measure performance; detect errors; prevent fraud; and improve the Services.
You may be able to control cookies through your browser settings. Disabling certain cookies may prevent some portions of the Services from functioning properly.
Where required by law, we will request consent before using nonessential analytics or advertising technologies.
7. Marketing and Notifications
Email Marketing: We may send promotional emails only where permitted by law. You may unsubscribe by selecting the unsubscribe link included in the email. You may still receive nonpromotional communications related to your account, security, purchases, subscription status, policy changes, and customer-support requests.
Push Notifications: With your permission, Body Axis™ may send push notifications about reminders, plans, progress, account activity, or new features. You can disable push notifications through your device settings.
8. Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These safeguards may include: encryption during transmission; access controls; authentication protections; restricted internal access; security monitoring; vendor-review procedures; and backup and recovery measures.
No method of electronic transmission, storage, or security is completely secure. Therefore, we cannot guarantee that information will never be accessed, disclosed, altered, lost, or destroyed without authorization.
You are responsible for maintaining the confidentiality of your account credentials and for notifying us if you believe your account has been compromised.
9. Data Retention
We retain personal information for only as long as reasonably necessary for the purposes described in this Privacy Policy, including to: maintain your account; provide the Services; preserve your progress and preferences; process subscriptions; complete transactions; resolve disputes; maintain security; enforce agreements; and comply with tax, accounting, and legal obligations.
The retention period may depend on the type of information, the reason it was collected, the sensitivity of the information, and applicable legal requirements.
When information is no longer needed, we will delete it, de-identify it, or securely isolate it until deletion is possible.
Some information may temporarily remain in encrypted backups or system logs after an account-deletion request. It will be deleted or overwritten according to our normal backup and retention schedule, unless continued retention is legally required.
10. Your Rights and Choices
Depending on where you live, you may have the right to: confirm whether we process your personal information; access personal information we hold about you; correct inaccurate information; request deletion of your information; obtain a portable copy of certain information; restrict or object to certain processing; withdraw consent; opt out of certain disclosures; opt out of targeted advertising; appeal a decision regarding a privacy request; and submit a complaint to an appropriate privacy authority.
You will not be discriminated against for exercising a privacy right.
We may need to verify your identity before completing a request. We will use information provided during verification only to confirm your identity and process the request.
Where permitted by law, an authorized agent may submit a request for you. We may require proof that the agent is authorized to act on your behalf.
